A new lawsuit has been filed against the classic three stripes trademark suspected of infringing Adidas, which requires the brand to immediately stop all sales of suspected infringing shoes and pay damages up to millions of dollars.

According to Adidas's document submitted to federal court in Portland, Oregon on Wednesday, Adidas accused the Danish shoe brand ECCO of deliberately adopting counterfeit or similar imitation three stripes trademark design to mislead and deceive consumers, believing that these goods were produced, authorized or licensed by Adidas, and originated from Adidas brand.

Adidas believes that the three stripes of ECCO are blatant disregard for Adidas's rights, and claims that ECCO knows very well what her company has done.

Therefore, brand behavior is deliberately and maliciously using the three striped trademark registered by Adidas to cause huge and irreparable damage to Adidas.

In the past year, adidas has filed a series of tort lawsuits against Marc Jacobs, Forever 21, APL and Skechers to safeguard its trademark rights.

But according to the intellectual property experts' suspicion, ECCO's shoe design does not completely replicate the three stripes of Adidas, which is a recognizable way for consumers.

The key to trademark infringement litigation is whether the use of alleged infringement will cause confusion to consumers.

Therefore, Adidas must prove that, in view of ECCO's alleged infringement of its three stripes trademarks, consumers are convinced that it has contact with Adidas or recognised the design of ECCO.

According to the document, Adidas requires ECCO to immediately and permanently stop all sales and distribution of all suspected footwear products, provide goods to Adidas to achieve destruction measures, and pay huge damages, which may be as high as millions of dollars.

As for whether the jury will be tried as required, some people in the industry believe that evidence based on Adidas's weakness is unlikely.
